TICKET TERMS AND CONDITIONS

TERMS AND CONDITIONS

 

Before continuing with any ticket purchase, please read the following Terms and Conditions carefully.

 

“TryBooking” means the ticketing agency used by ROCKIT Productions PTY LTD.

“Event” means an event to be held at the Venue.

“ROCKIT Productions” means ROCKIT Productions PTY LTD, it’s representatives, servants, employees and sub-contractors and “We/Our” shall be read accordingly.

"Terms and Conditions" means these terms and conditions.

“Venue” means the venue as stated on the Ticket.

"Ticket" means any ticket for an Event.

“You” means you or anybody who in ROCKIT Production’s reasonable opinion is acting with your authority or permission and "Your" shall be read accordingly. 

“Patrons” means all event attendees including you, your booking party, and those who you purchased tickets for.

 

 

APPLICATION OF TERMS

1. By purchasing a ticket through TryBooking, you acknowledge and agree to comply with these Terms and Conditions.

2. Tickets are sold or issued by TryBooking as an agent for ROCKIT Productions. The name of the Presenter and/or the venue to which your ticket relates is usually shown on the front of the ticket but is also available from TryBooking or the ROCKIT Productions website. All ticketing complaints and claims, and your legal rights, are as against ROCKIT Productions, except where TryBooking is at fault.

3. The Venue’s conditions of entry are incorporated into these Terms and Conditions and apply to your ticket.

4. Your ticket may be subject to additional booking terms, which will be notified to you prior to purchase.

 

TICKET PURCHASES

5. Tickets are only valid if purchased through TryBooking or the Box Office.

6. Ticket sales may be limited to a specified number of tickets.

7. Ticket proceeds will be refunded if the event does not proceed.

8. Once confirmed, your ticket and any transaction fee will not be refunded or exchanged, except for cancellation of the event.

9. Bookings are subject to availability.

 

PRICING AND PAYMENT

10. All prices quoted are in Australian dollars and include GST. 

11. Prices are subject to change without notice.

12. A transaction fee may apply to your ticket purchase. The amount of this fee can vary depending on the event and you will be notified of the applicable fee prior to purchase.

13. You warrant that you have the authority to make payment for your ticket and that you own/hold or have express permission of the owner/holder of the credit card or other payment facility used to purchase the ticket.

14. If the amount you pay for your ticket is incorrect (regardless of whether the error arose due to an advertising error online or otherwise communicated to you, human error or a technical malfunction), ROCKIT Productions may cancel the ticket and refund to you the amount that you paid and may offer a replacement ticket to you at the correct price.

 

DELIVERY, COLLECTION AND PRINTING OF TICKETS

15. Delivery of tickets will only be made upon receipt of full payment. You may self-print an e-ticket through email receipt of booking confirmation or from the Venue’s Box Office

16. If you elect to self-print an e-ticket, then: 

a) in the event that a duplicate copy of this ticket appears, ROCKIT Productions reserves the right to request proof of identity and proof of purchase. Unauthorised duplicate ticket holders will be refused entry to the Venue; and

b) you are responsible for printing the ticket.

 

LOST OR STOLEN TICKETS

17. Where tickets are lost, stolen, misplaced or destroyed, ROCKIT Productions may charge an administration fee to issue replacement tickets and may require proof of identity and purchase, prior to issuing a replacement ticket.

18. ROCKIT Productions may not provide replacement tickets where tickets are for general admission rather than allocated seating.

 

CONDITIONS OF ENTRY

19. Attendance at the event and the right of admission is reserved by ROCKIT Productions.

20. By attending an Event, you agree to the Venue’s conditions of entry.

21. The use of photographic or recording devices of any kind is strictly prohibited at all times. If caught using such devices, you will be escorted from the Venue and will hand over any and all devices used to the Front Of House Team where all previously recorded material will be deleted and destroyed on site.

22. You may be refused entry or required to leave the Venue if you do not comply with the Venue’s conditions of entry. Tickets will not be exchanged or refunded in these circumstances.

 

REFUNDS, CANCELLATIONS AND CHANGES

23. If an event is cancelled, rescheduled or significantly relocated, ROCKIT Productions will attempt to notify ticket holders of the cancellation, rescheduling or relocation. 

24. You may be entitled to a refund where an event is cancelled, rescheduled or significantly relocated. If the event is cancelled, rescheduled or significantly relocated, ROCKIT Productions will not reimburse you for auxiliary expenses (such as the cost of travel, car-parking, child-care and accommodation) or other consequential loss suffered by you in connection with your attendance or non-attendance at an event.

25. ROCKIT Productions are not liable to refund to you any amount beyond the face value of the ticket plus any transaction fee.

 

PRIVACY

26. By purchasing a ticket through ROCKIT Productions and thus, TryBooking, you consent to the collection, use, disclosure and handling of your personal information.

 

VOLUNTARY ASSUMPTION OF RISK

27. You enter the Venue at your own risk.

28. You understand that attendance at any event and/or the Venue may carry with it certain dangers, including the risk of injury and damage to you or your property.

29. By attending the event and/or the Venue, you accept the risk of damage and loss (including property damage, personal injury, economic and consequential loss) howsoever arising (including by negligence) at the Venue. This includes damage or loss caused by the acts or omissions of other ticket holders, visitors, guests, performers, and the employees and representatives of ROCKIT Productions, the Venue, and the Presenter.

 

LIMITATION OF LIABILITY

30. ROCKIT Productions are not liable to you for any loss, damage, injury, delays, additional expenses or inconvenience arising as a result of your attendance or non-attendance at the Venue and/or the Event.

 

GENERAL

31. These Terms and Conditions may be varied at any time. Any variations become effective on the day immediately after their publication on the ROCKIT Productions or TryBooking website and apply to any purchases made after that date.

32. If any part of these Terms and Conditions is held to be invalid, illegal or unenforceable, it will be disregarded to the extent of its invalidity and the remainder of these Terms and Conditions will remain in full force and effect.

 

 

COVID-19 PANDEMIC RESPONSE

33. By purchasing tickets, you agree to provide your contact details including mobile phone number, email address, and residential address, along with the contact phone number, email address, and residential address of accompanying ticket holders. 

34. These contact details, along with seating allocations, will be kept by ROCKIT Productions for 56 days from the day of the performance.

35. Patrons acknowledge ROCKIT Productions may be required by law to provide contact information to public health officers on request.

36. ROCKIT Productions will not share this contact information with any third party other than the relevant health authority, and will not use the information for promotional purposes. 

37. We reserve the right to refuse service and/or entry to the venue whereby an event attendee refuses to co-operate in supplying aforementioned contact details or failing to provide accurate information.

38. Patrons must not attend if they have COVID-19 related symptoms, have been in close contact with a person who is COVID-19 positive, have travelled overseas or to a COVID-19 hotspot in the past 14 days or are COVID-19 positive. 

39. Patrons must not attend if they are required to self-isolate and the event falls within the isolation period.

40. Patrons agree to abide by all social distancing and health protocols. 

41. Patrons agree to follow the instructions of venue staff at all times. 

42. Patrons acknowledge covid safe requirements can change without notice and in such a case, provide consent to partake in temperature testing or the wearing of a face mask, should such precautions be required on the day of the event.

43. If patrons do not comply with protocols or authorised requests when on the venue premises they may be asked to leave immediately without refund or further recourse. 

44. Refunds or exchange of tickets will be available to any customer who is  required to self-isolate (due to being a confirmed case or is a close contact of a confirmed case) and the event falls within the isolation period. 

45. Seating capacity is at 100% and while social distancing is preferred, the location and spacing of seats may place groups from different social groups next to each other and the company reserves the right to change the seating layout without notice.

46. Disclaimer: Patrons acknowledge that while the venue has taken all reasonable health and safety precautions to keep the audience, staff and performers safe, patrons enter the venue at their own risk without recourse to claim against the venue regarding health outcomes. 

47. If you or a member of your booking party become unwell and suspect infection after the event, please contact ROCKIT Productions immediately via phone (0407 266 583) or email (admin@rockitproductions.com.au) and your local health authority.

Before you come in:

• visit www.covid19.qld.gov.au/check-in-qld for links to download the app from Google Play or Apple App stores

• enter your details once when you first open the app 

 

When you come in:

• open the app on your phone

• select ‘Check in Now’ and scan or enter our code

 

Please keep your phone handy as you will need to show the Ushers your successful check in page before entering. If you do not have a QR capable device, the Ushers can manually enter your details, just let them know when being seated.
